| BOOKING CONDITIONS | ||||||
Please read the conditions below carefully before you book your holiday as these set out contractual Terms and Conditions which apply to any bookings made by YOU with Chillout365 Ltd, 25 Deepdene Wood, Dorking, Surrey, RH5 4BQ, UK. Registered in England No. 4255016. If you book only one aspect of your holiday with us – for example Only Hotels OR Guide OR Internal Transport within India - then Chillout365 Ltd act only as booking agents for the supplier of the arrangement and your contract will be subject to Booking Conditions of that supplier and not Chillout365 Ltd. MAKING YOUR BOOKING To make a booking your formal confirmation will be necessary, accepting on behalf of all your party the terms of the Booking Conditions. A non refundable deposit of £200 per person OR 10% of the total holiday cost – whichever is greater, plus cost of any air tickets to be issued – is required at time of booking, together with any applicable non-refundable visa fee or travel insurance premium. If you book less than 60 days before departure full payment will be required at time of booking. For some resorts we may require a higher non-refundable deposit due to booking conditions imposed by the resorts. We will advise you at time of booking. On receipt of your confirmation and payment Chillout365 will issue a Confirmation Invoice which will include your requested itinerary cost and you will be advised of any accommodation that is still on request and not confirmed. You will be kept informed of progress on requests. The contract between you and Chillout365 Ltd only comes into effect when all reservations are confirmed and a Confirmation Invoice issued. BALANCE PAYMENT The balance payment of the price of your holiday must be received at least 60 days before departure or at time of booking if booking is made less than 60 days before departure. If the balance is not paid in time Chillout365 Ltd reserve the right to cancel your holiday and retain your deposit and apply the cancellation charges BOOKING ALTERATIONS If you wish to alter your booking in any way after the Confirmation Invoice has been issued – Chillout365 Ltd will do their utmost to make the changes - provided that notification of required amendments is received in writing from the person who signed the original Confirmation Letter – at least 30 days before departure. Cost of amendments will be advised at time of amendment request. Any alteration by you requested within 14 days before departure will be treated as a cancellation of the original booking and subject to cancellation charges. If an amendment is requested after the commencement of your holiday – we at Chillout365 Ltd will do our best to implement the amendments but cannot guarantee it. In the event of any requested amendment being made you will be liable for any cancellation charges levied by the provider of the original booked service and for any costs Chillout365 Ltd may incur in attempting to secure the amended arrangements. CANCELLATION You or any member of your party may cancel the holiday at any time providing Chillour365 Ltd receive written confirmation signed by the person signing the original Confirmation Letter at time of booking. In the event of a cancellation your deposit will be retained and following cancellation charges will apply
Some resorts levy cancellation charges equal to only one night’s stay, some resorts levy 100% cancellation charges for the entire stay if cancelled less than 30 days before arrival date – where this is applicable Chillout365 Ltd will adjust the cancellation charges appropriately. Where – due to unavoidable circumstances – you are unable to travel and wish to transfer your holiday to another person, Chillout365 Ltd will try their utmost to assist you, provided the transfer is requested at least 30 days before departure - in writing - by the person who signed the original Confirmation Letter. Where the holiday is transferred both you and the person to whom it is transferred will be jointly and individually responsible to pay Chillout365 Ltd the price of the holiday or balance due together with any costs Chillout365 Ltd may incur in effecting the transfer. CANCELLATION OF YOUR HOLIDAY FOR BHUTAN If after arrival in Bhutan you cancel your holiday for any reason whatsoever , then 100% cancellation charges will apply. CANCELLATION OF YOUR HOLIDAY BY CHILLOUT365 LTD In circumstances where Chillout365 Ltd are unable to provide the holiday booked by you – Chillout365 Ltd will refund to you all monies paid or offer an alternative holiday of equivalent standard (subject to availability). ALTERATIONS TO YOUR HOLIDAY BY CHILLOUT365 LTD Occasionally changes – major or minor- may have to be made to your holiday for eg hotel accommodation or other travel arrangements. Where a change is a major change – for eg type or standard of accommodation – Chillout365 Ltd will advise you as soon as is reasonably possible. You will then have a choice of accepting the change or cancelling the booking and taking a full refund. You may take the choice of taking an alternative holiday. Where the alternative booking is of a lower price Chillout365 Ltd will refund you the difference in price between the original booking and the new alternative booking. Where the alternative is of a higher price you will have to pay Chillout365 Ltd the difference between the price of the original booking and the alternative booking. PRICES Once your booking is confirmed Chillout365 Ltd will not make any changes to the price of your holiday unless there is a change in
If changes in price amount to more than 10% of your holiday, you will be entitled to cancel your holiday and take a full refund of monies paid except monies paid for Visa, Insurance premium, any amendment charges, flights (where tickets have been issued). You must exercise your right of cancellation within 14 days from the date of notification to you by Chillout365 Ltd. YOUR RESPONSIBILITY PROVISION OF SERVICES Whilst you are on holiday – if Chillout365 Ltd become aware of unavailability or not able to provide a significant proportion of services quoted in your itinerary , Chillout365 Ltd will do their utmost to make alternative suitable arrangements at no extra cost to you. Where appropriate Chillout365 Ltd will compensate you for the difference between the services set out in your itinerary and those actually supplied. Where alternative arrangements are not possible or not acceptable to you , Chillout365 Ltd will – where appropriate – arrange for you to return to the location from which you departed at the commencement of your holiday by the same form of transport used for your outbound journey – provided that the transport arrangements of the outbound journey were provided by Chillout365 Ltd, for eg International flights from your country of departure to India. Where International flights are booked by you, your holiday with Chillout365 Ltd will commence upon your arrival in India as per itinerary given to you by Chillout365 Ltd. Where alternative arrangements are not acceptable to you - you may cancel the unused part of your holiday and obtain a refund equivalent to the unused part of your holiday provided this is in compliance with the terms and conditions as set out by the various service providers for example resorts. WHAT IS INCLUDED IN YOUR TOUR PRICE All road, rail and air transport in India and Bhutan as detailed in the itinerary Transfers and sightseeing as detailed in the itinerary Twin sharing accommodation with private bath or shower and toilet in each room where available Meals as described in the itinerary Services of our tour guides as detailed in the itinerary Excursions and sightseeing as set out in the itinerary WHAT IS NOT INCLUDED IN YOUR TOUR PRICE Travel Insurance Cost of Passport and Visa Cost of additional items such as laundry, drinks, telephone calls and any other items not specified in the itinerary Meals – unless specified in the itinerary Optional excursions Tips / gratuities Single room supplement Any flight supplements Any optional extras International flights – unless specified in the itinerary SPECIAL REQUESTS Any special requests you have should be advised in writing by the person signing the Confirmation Letter at time of booking. Chilllout365 Ltd will do their utmost to comply with your requests – but this however cannot be guaranteed. Chillout365 Ltd has no liability to you if your requests are not complied with. COMPLAINTS If you have a problem during your holiday this must be reported to our representative or the manager of the resort in which you are staying or the service provider for that particular service. If your complaint is not resolved locally please report this to Chillout365 Ltd within 48 hrs by fax , phone or e-mail and Chillout365 Ltd will endeavour to resolve the matter while you are still on holiday. If the matter is not satisfactorily resolved please write to Chillout365 Ltd within 30 days. Chillout365 Ltd will investigate the problem and try to resolve it but this cannot be guaranteed. ARBITRATION Any dispute between you and Chillout365 Ltd – which has not been amicably resolved – may be referred to arbitration under a special scheme devised for the Travel Industry by the Institute of Arbitrators. CONDITIONS OF CARRIAGE Where air travel is included in your itinerary, the conditions of carriage of that airline will apply. A child must be under 12 years of age and an infant under two years of age at the date of travel. There is no guarantee that flights will depart at the time specified and Chillout365 Ltd accept no liability for any delay. COMMUNICATION OF INFORMATION All communications with you will be communicated to the person signing the Confirmation Letter. It is your responsibility to ensure that all members of your party receive a copy of the communication. Chillout365 Ltd accept no responsibility for your failure to do so. TREKKING AND ADVENTURE SPORTS You must be medically fit to take part in Trekking and Activity Holidays. You are strongly advised to consult your doctor before taking part in Trekking and Activity Holidays offered by Chillout365 Ltd as part of your itinerary. Our guides are experienced and as per regulations approved by and registered with Govt. of India. It is your responsibility to ensure that you are fit enough to take part in Trekking and Activity Holidays. Chillout365 Ltd will not accept responsibility for any accidents due to undisclosed medical conditions. A written confirmation – signed by the person who signed the original Confirmation Letter - will be required that you and your party are fit to take part in Trekking and Activity Holidays. PROTECTION FROM SUN You are strongly advised to take adequate protection against sunburn. It would be advisable to use sun protection lotions, wear a wide brimmed hat or scarf, light cotton clothing and open sandals. Chillout365 Ltd accept no responsibility for any illness caused due to sun burn. DATA PROTECTION POLICY In order to process your booking we need to use the information you provide such as name, address, disabilities, dietary, religious requirements etc. The information may be provided to credit checking companies, airlines, hotels. We will not pass on your information to anyone not responsible for all or part of your travel arrangements. In making this booking you consent to this information being passed on to the relevant persons. THIS CONTRACT If any of the Booking Conditions above are found to be invalid or unenforceable, then the remainder of these Booking Conditions will not be affected and will remain valid and enforceable. This contract is made under terms and conditions of the English Law and both parties shall submit to the jurisdiction of English Courts at all times. |
